With the new Tribunal Hearing fees coming into force, clients will find it increasingly difficult to bring employment tribunal actions. Not only may they have had their source of income removed, they will be faced having to find £1,200 to take on their former employer.
We don't think this is fair nor viable. We have therefore developed a disbursement funding solution for clients whereby, subject to conditions, the Tribunal Hearing Fee of £950 (or £230 for Level 1 Claims) may be lent to them backed by our After The Event Insurance. This means that your client will be able to pursue their claim without fear of being unable to afford the Hearing Fee should the case proceed to that stage.
If the case is lost or abandoned without any benefit accruing to the client, the After the Event Insurance will pay off the loan and charges on the client's behalf as well as the Tribunal Claim Issue Fee and any other disbursements. This means that they can proceed with their claim without the fear of financial ruin should they lose.
In the event that their case is successful, the Employment Tribunal will almost always award the client the Hearing and Issue fees and so the loan can be repaid. The small fixed charges for the facility and the After the Event Insurance would then need to be deducted from the client's financial award.
We believe this is an important and necessary addition to our product range.
