It is often prudent and also economic to instruct counsel to appear at a final tribunal hearing. Clients however, are understandably reluctant to incur a barrister's fee which must be paid even if the claim is unsuccessful. Fortunately, our 'Counsel Cover' option will cover Counsel’s brief fee if the claim is unsuccessful.
'Counsel Cover' is available for just a small additional premium and will pay up to £1,000 of counsel’s fees if a claim is unsuccessful at a tribunal hearing.
The 'Counsel Cover' option must be selected when the FeeSafe policy is requested, but like the FeeSafe premium itself, the 'Counsel Cover' premium is payable only when the claim is successful and compensation has been recovered.
If the claim is successful then clients will pay their barrister’s fees in the usual way and will also pay the 'Counsel Cover' premium once compensation has been received.
If the claim is unsuccessful then 'Counsel Cover' will pay counsel's brief fee for the tribunal hearing, up to the policy limit. In addition 'Counsel Cover' “self-insures” its own premium, so your client will have no premium to pay.
This is an excellent additional option for your employment clients to choose.
